A staff member may agree to maintain the average number of hours worked over a fixed period of up to four weeks. As a general rule, in accordance with section 30 of the Employment Standards Regulation, a request for exemption is submitted by correspondence. This letter must be signed by the employer and by a majority of the workers concerned by the derogation. Workers affected by an additional time gap must work or earn wages throughout the shiftwork cycle. If the employee does not have enough work to work full-time, overtime must be paid.
